In most cases, it is necessary to obtain a grant of probate or letters of administration in order to deal with the deceased’s assets.   Grants of probate or letters of administration are court orders that serve as evidence of the rights of the personal representatives to deal with the estate.   

An inquiry may be made by the Probate Registry in Hong Kong as to which jurisdiction should govern the entitlement to the grant and administration if some foreign elements are involved.   The Probate Registrar in Hong Kong is under a duty to make inquiries and would issue grant if they are satisfied that the inquiries are satisfactorily answered and there be no outstanding caveats against the estate.
